TERMS AND CONDITIONS
Conclusion of the Agreement between the Buyer and the Seller can occur in two ways.
The Buyer has the right to negotiate all terms of the agreement with the Seller before placing an order, including amendments to the provisions of the following regulations. Such negotiations can only be conducted in writing, addressed to the Seller at:

If the Buyer chooses not to make individual arrangements regarding the method and terms of concluding the agreement, the provisions of these regulations shall apply, subject to mandatory legal provisions.

§ 1 Definitions
Postal Address – data identifying the recipient of a shipment: name and surname or institution name, street, building number, apartment or premises number (if applicable), postal code, and city.

Proof of purchase – VAT invoice or fiscal receipt issued in accordance with applicable law.
Product Card – a subpage of the online store containing detailed information about a given product.
Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality but having legal capacity, making a purchase from the Seller in connection with their business or professional activity.
Civil Code – the Act of April 23, 1964, Civil Code (Journal of Laws 1964 No. 16, item 93, as amended).
Consumer – a natural person who makes a legal transaction with an entrepreneur not directly related to their business or professional activity and a natural person concluding a contract directly related to their business activity when the content of the contract indicates that it does not have a professional character for them.
Basket – a list of products selected by the Buyer during the order process.
Buyer – both Consumer and Customer.
Place of delivery – postal address or collection point indicated by the Buyer in the order.
Moment of delivery – the moment when the Buyer or a third party indicated by the Buyer takes possession of the item.
Payment – payment for the order in the manner chosen by the Buyer.
Consumer Law – the Act of May 30, 2014, on consumer rights (Journal of Laws 2014, item 827, as amended).
Product – the minimum unit of goods that can be ordered.
Subject of the Agreement – products and their delivery, which are the subject of the order.
Subject of Performance – the same as the subject of the agreement.
Collection Point – a place of receipt of items other than the postal address, indicated by the Seller in the store.
Reservation – placing an order with the payment option as “payment to the account.”
Item – a movable item that can be the subject of a contract.
Store – an online service available at https://www.gtg.com.pl through which the Buyer can place an order.
Seller:

System – a set of cooperating IT devices and software, ensuring the processing and storage, as well as sending and receiving data through telecommunications networks.
Execution time – the number of working days or weeks indicated on the product card.
Agreement – a distance agreement within the meaning of the Consumer Rights Act or a sales contract within the meaning of Article 535 of the Civil Code.
Defect – physical or legal defect.
Physical defect – non-compliance of the sold item with the contract, including, among other things, the lack of properties that an item of this kind should have or damage.
Legal defect – a situation where the sold item is owned by a third party or is encumbered with the right of a third party.
Newsletter – a service involving the delivery of commercial and marketing information by the Seller via electronic communication means.
Order – a declaration of intent by the Buyer aiming to conclude a sales contract.
§ 2 General Conditions
1. Information available on the Store's website does not constitute an offer under Article 66 of the Civil Code but is an invitation for Buyers to submit offers.
2. The contract is concluded in Polish and is governed by Polish law and the provisions of these Terms and Conditions.
3. The place of delivery may be outside the territory of the Republic of Poland.
4. The Seller is committed to delivering goods free from defects.
5. All prices listed in the store are gross (including VAT) and are expressed in Polish zlotys (PLN) or euros (EUR). Prices do not include delivery costs, which are determined during the order process.
6. The Seller provides the Buyer with a lifetime warranty on the sewing components of the Seller's own products. The warranty covers only products used according to their intended purpose. In case of a defect, the Buyer should return the product to the Seller, who will, if the defect is confirmed, either repair it, replace it with a new product, or refund the price – according to the Buyer’s choice.
7. The Seller sends the Buyer an order confirmation, information about the right to withdraw from the contract, these Terms and Conditions in PDF format, and a withdrawal form template electronically to the email address provided by the Buyer.
8. The Seller does not charge any fees for communication using distance communication methods. The Buyer bears the costs arising from agreements made with third parties providing specific services.
9. The Seller ensures the proper operation of the store on specified web browsers with up-to-date software versions.
10. The Seller is liable for products and the operation of the store to the extent required by applicable law. In other cases, the Seller’s liability is limited to 100% of the net value of the subject of the contract.
11. The Buyer can save their data in the store to facilitate the process of placing subsequent orders. The Buyer has the option to view, correct, update their data, and delete their account in the store.
12. Promotions organized by the Seller cannot be combined unless the terms of the promotion or information about the promotion state otherwise.
13. Products shown in photos on the store may be displayed with other items, but sales are limited to the products specified on the product page.
14. Uniformed personnel may apply for special discounts. Detailed information is available by contacting the Seller via email at: gtg@gtg.com.pl.
15. Gift cards available in the store can only be redeemed for retail sales.
16. Wholesale customers may apply for special purchasing conditions by contacting the Seller via email at: b2b@gtg.com.pl.
17. Users of the store are required to use it in accordance with the law and good manners, respecting personal rights and the intellectual property rights of the Seller and third parties.
§ 3 Technical Requirements
1. To properly use the Store, Customers need all of the following:
1) an internet connection;
2) devices that allow for the use of internet resources;
3) use of a web browser that allows the display of hypertext documents on the device screen, linked in the internet network through the WWW service, and supporting the JavaScript programming language, and also accepting cookies;
4) having an active email account.
2. In the Store, it is prohibited for Customers to use viruses, bots, worms, or other computer codes, files, or programs (especially those automating scripts and applications or other codes, files, or tools).
3. The Seller informs that they use cryptographic protection of electronic transfer and digital content by applying appropriate logical, organizational, and technical measures, particularly to prevent unauthorized access to data, including through SSL encryption, password protection, antivirus software, or anti-malware programs.
4. The Seller informs that despite the security measures referred to in paragraph 3 above, using the internet and services provided electronically may be threatened by harmful software entering the IT system and the Customer's device or by unauthorized access to data on that device by third parties. To minimize this threat, the Seller recommends using antivirus software or measures protecting identification on the internet.
§ 4 Placing an Order
1. The Buyer can place an order without the need to create an account.
2. Placing an order involves:
- Adding products to the cart;
- Confirming and accepting the Terms and Conditions and Privacy Policy;
- Selecting the payment method;
- Choosing the location for pickup;
- Choosing the delivery method;
- Placing the order with a payment obligation.
3. The Buyer may make changes to the order until it is confirmed by the Seller.
4. Confirmation of the order by the Seller occurs through sending an email to the address provided by the Buyer.
5. The Buyer is required to provide accurate and truthful personal information.
6. If the order cannot be fulfilled due to stock depletion, the Buyer will be promptly informed of this situation and asked to decide on further steps (cancellation, partial fulfillment, waiting for availability).
7. The Seller reserves the right to refuse to process an order if there are reasonable doubts about the accuracy or authenticity of the Buyer’s information.
8. The order fulfillment time is counted from the day the payment is recorded in the Seller’s bank account.
§ 5 Payments
1. The Buyer may choose one of the available payment methods:
- Bank transfer to the Seller’s account;
- Payment by credit or debit card (Stripe);
- Online payment PayPal or Revolut Pay system.
2. If the Buyer chooses to pay by bank transfer, they are required to make the payment within 5 business days from the order confirmation date. Otherwise, the order will be canceled.
3. The Seller reserves the right to verify the authenticity of the transaction.
4. All payments are processed by professional payment service providers who ensure a high level of security and data protection.
5. If the Customer chooses the payment method specified in point 1a., failure to receive the payment in the Seller’s account within 3 business days from the date of the Sales Agreement, and subsequently within an additional period designated by the Seller, allows the Seller to withdraw from the Sales Agreement.
§ 6 Delivery
1. The Buyer has the right to choose one of the available delivery options:
- DPD Polska Courier - Poland and international shipments
- DPD Polska - cash on delivery - Poland
- InPost Parcel Lockers - Poland
- UPS - international shipments
- DHL - international shipments
2. Goods are delivered to specified countries outside the territory of the Republic of Poland via international shipments, after the order has been pre-paid.
3. Delivery costs are indicated at the stage of placing the order.
4. The Buyer bears the delivery costs.
5. When a delivery time is specified in business days, this term includes all days from Monday to Friday, excluding statutory holidays.
6. The order fulfillment time for products in stock is 2-3 business days within Poland and 3-5 business days for international shipments. For products available on order, the fulfillment time is up to 10 business days. Information on product availability is provided in the cart under the respective product.
7. The order fulfillment time mentioned in point 6 is counted as follows:
- For payment by bank transfer, electronic payments, or credit card – from the day the Seller's bank account or settlement account is credited.
- For cash on delivery – from the day of concluding the Sales Agreement.
- For deferred payment via Klarna – from the day the Seller is notified by the lender about the conclusion of a credit agreement with the Buyer, but no later than from the day the Seller's bank account is credited with the loan funds granted to the Buyer.
8. The Seller is not responsible for delays in delivery caused by the carrier's fault.
9. The Buyer is obliged to collect the shipment and check it in the presence of the courier. In case of damage, the Buyer should prepare a damage report and promptly contact the Seller.
10. The Customer will be notified of the delivery date after the goods have been dispatched by the Store (status of the order will be updated). Any changes to the delivery date can only be made based on arrangements made directly between the Customer and the courier company. Deliveries of Products occur on business days.
§ 7 Complaints and guarantees
1. The provisions of this paragraph apply to complaints regarding Goods purchased by a Consumer or an Entrepreneur treated as a Consumer up to December 31, 2022. If the purchased Goods have a physical or legal defect, the Seller is liable to the Customer who is a Consumer or an Entrepreneur treated as a Consumer under Article 556 and subsequent articles of the Civil Code (warranty).
2. In the event of identifying defects or non-compliance with the contract, the Buyer has the right to file a complaint within 14 days of receiving the order. The product must not show signs of use and must have its original packaging and labels.
3. Complaints should be directed to the Seller’s complaint address: gtg@gtg.com.pl, along with proof of purchase and a description of the defect.
4. The Seller undertakes to consider the complaint within 14 days from the date of its receipt. Failure to respond within this period means that the complaint is considered accepted.
5. In the case of an accepted complaint, the Seller commits to removing the defect, replacing the product with a new one, or refunding the price, according to the Buyer’s choice.
6. The warranty does not cover damages resulting from improper use, including improper cleaning, alterations, or repairs carried out by third parties.
7. For products covered by the manufacturer's warranty, contact the Seller at: gtg@gtg.com.pl. Please include proof of purchase, photos of the defect, and a detailed description in your message. The Seller has 14 days to process the warranty claim and provide a decision.
§ 8 Right of Withdrawal
1. The provisions of this § 8 apply solely to Buyers who are Consumers or Entrepreneurs with consumer rights.
2. The Buyer has the right to withdraw from the Sales Agreement without providing any reason within 14 (fourteen) days from the date of receipt of the Goods by the Buyer or by a third party designated by the Buyer who is not the carrier.
3. The right to withdraw from the Sales Agreement is exercised by the Buyer by submitting a withdrawal statement to the Seller (hereinafter referred to as the "Statement"). To meet the deadline for withdrawing from the Sales Agreement, it is sufficient to send the Statement before the deadline mentioned in section 2 above.
4. The Statement can be made by the Buyer in any form. However, to facilitate the exercise of the right to withdraw from the Sales Agreement, the Seller recommends submitting the Statement as indicated in sections 5-8 below.
5. The Buyer may submit the Statement in the following forms:
1) electronically;
2) on paper.
6. If choosing the electronic form, the Buyer should send an email to gtg@gtg.com.pl containing the following elements:
1) the Buyer's first and last name;
2) email address;
3) correspondence address;
4) a clear statement of withdrawal from the Sales Agreement;
5) identification of the Goods related to the withdrawal from the Sales Agreement;
6) Order number;
7) date of the Order;
8) PKD codes of the business activity conducted by the Buyer (if the Buyer is an Entrepreneur with consumer rights).
7. If choosing the paper form, the Buyer should print and complete the form available on the Seller's website in the Returns section, and then send it along with the Goods to: GINGER'S TACTICAL GEAR DANIEL RAUSZ, ul. Bora Komorowskiego 24, 80-377 Gdańsk, Poland. The Seller will send the Buyer a confirmation of receipt of the Statement promptly after receiving it, via email.
8. In the case of exercising the right to withdraw from the Sales Agreement, the Buyer should return the Goods to the Seller within 14 (fourteen) days from the date of withdrawal from the Sales Agreement. To meet the deadline mentioned in the preceding sentence, it is sufficient to dispatch the Goods before the deadline.
9. The Buyer bears the direct costs of returning the Goods.
10. The refund of payments made by the Buyer will be processed after the Seller receives the returned Goods or proof of its return from the Buyer, whichever occurs first. The refund will be made using the same payment method used by the Buyer in the original transaction, unless the Buyer expressly agrees to another method. The Buyer will not incur any costs for the refund of the payment.
11. The Buyer is responsible for any diminished value of the Goods resulting from use beyond what was necessary to ascertain the nature, characteristics, and functioning of the Goods.
12. The right to withdraw from the Sales Agreement does not apply to the Buyer in the following cases:
1) the Goods show signs of use;
2) the Goods were custom-made and elements were changed at the request of the Buyer.
§ 9 Creating an Individual Account
1. To create an Individual Account, the Customer is required to complete a free registration of their data in the Store's database.
2. Data registration is done by filling out the registration form available in the "Account" section (the silhouette icon) and selecting the "Register" option. The form requires the following information: first and last name, email address, and setting a unique password for the Customer.
3. The condition for creating an Individual Account is the acceptance of the Terms and Conditions and the Privacy Policy by marking the appropriate checkbox in the form.
4. After submitting the completed registration form, the Customer will promptly receive an email confirmation of the Individual Account registration from the Seller at the email address provided in the registration form. At this point, the agreement for the electronic provision of the Individual Account service is concluded, and the Customer gains access to the Individual Account and can make changes to their data provided during registration.
§ 10 Newsletter
1. The Seller takes actions to ensure the proper functioning of the Store to the extent that results from current technical knowledge and undertakes to remove any irregularities reported by Customers within a reasonable time frame.
2. In addition to enabling the conclusion of Sales Agreements via the Store in accordance with these Terms and Conditions, the Seller also provides the following services free of charge to Customers electronically:
1) Newsletter service,
2) Individual Account service,
3) Product Availability Notification and Product Reservation service.
3. To start the Newsletter service, the Customer must consent to receiving the Newsletter by providing their email address in the appropriate field on the Store's website or selecting the option in the form when placing an order, and confirming it by clicking the activation link sent by the Seller to the email address provided by the Customer (the moment of commencement of the Newsletter delivery service).
4. The Newsletter is provided free of charge for an indefinite period. The Customer has the right to unsubscribe from the Newsletter (cancel the Newsletter) at any time and without giving any reason, in particular by clicking the deactivation link included in every Newsletter sent to the Customer in the form of an email or by sending an appropriate request to the Seller using the contact details provided.
5. The Individual Account service is available after registering data in the Store's system under the rules described in § 9 of the Terms and Conditions and consists of providing the Customer with an individual panel in the Seller's IT system, allowing the Customer to use additional functionalities of the Store's website, such as modifying Customer data, maintaining the Customer's session after logging into the Individual Account, storing, and providing the Customer with order history, tracking the status of orders.
6. The Product Availability Notification and Product Reservation service is available after filling in the appropriate field with an email address.
7. The Customer is entitled to request the cessation of the services indicated in paragraph 1 at any time. In such a case, the agreement for the provision of the Newsletter or Individual Account service is terminated, and the Seller has 14 days to accordingly delete the Individual Account or remove the Customer's data from the database of persons who have consented to receive the Newsletter, subject to the principles of processing Customers' personal data contained in the "Privacy Policy" document, available on the Store's website under the "Privacy Policy" tab.
§ 11 Privacy Policy
1. The Buyer’s personal data is processed by the Seller as the data controller.
2. Detailed information on the processing of personal data is provided in the Privacy Policy available on the store’s website.
3. The Buyer has the right to access, rectify, delete, or restrict the processing of their personal data, the right to object to processing, and the right to data portability.
4. The Buyer has the right to lodge a complaint with the supervisory authority if they believe that the processing of their personal data violates the law.
5. Providing personal data is voluntary, but necessary for placing an order.
§ 12 Final Provisions
1. These Terms and Conditions come into effect on the date they are published on the store's website.
2. The Seller may amend the Terms and Conditions in the event of:
1) changes to the Seller's details;
2) changes to the Seller's business activities;
3) the introduction of new services by the Seller, modification of existing services, or cessation of service delivery;
4) technical modifications to the Store requiring adjustments to the Terms and Conditions;
5) legal obligations requiring changes, including adjustments to the Terms and Conditions to reflect the current legal state.
3. Customers will be informed of changes to the Terms and Conditions by publishing the amended version on the store's website. At the same time, the amended version will be sent to Users via email.
4. For sales contracts concluded before the date of publication of the new Terms and Conditions on the store's website, the provisions of the previously applicable Terms and Conditions will apply.
5. A User who does not agree to the changes in the Terms and Conditions may terminate the Account Service Agreement with immediate effect within 7 (seven) days of receiving the amended version of the Terms and Conditions via email. Failure to terminate is considered as acceptance of the changes to the Terms and Conditions.
6. Termination of the Account Service Agreement is effected by the User submitting a termination statement to the Seller. The statement referred to in the preceding sentence may be sent via email to the address specified in § 1, section 4, point 1 of the Terms and Conditions.
7. Immediately upon receiving the statement referred to in section 6 above, the Seller will delete the Account.
8. Any disputes arising from contracts between the Seller and the Buyer will be resolved by the court with local jurisdiction according to the Seller's registered office.
1) In matters not regulated by these Terms and Conditions, Polish law shall apply.
2) The Buyer declares that they have read and accept the provisions of the Terms and Conditions.
